1. Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of the ElecSnap GBR mobile application (the "App") and the eleccerts.co.uk website (together, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

These Terms apply to all users of the Services. For the avoidance of doubt, these Terms apply only to ElecSnap GBR and our website; no other applications are covered.

2. Use Licence

Subject to your compliance with these Terms, ElecCerts Software Ltd ("ElecCerts", "we", "us") grants you a limited, revocable, non-exclusive, non-transferable licence to install and use the App on devices you own or control, solely for your professional electrical contracting activities.

You may:

• Download and use the App on your compatible devices
• Use the App to organise photographic evidence, notes and related data for electrical inspection work
• Export, share, and back up reports generated by the App
• If available, use team features to collaborate with authorised colleagues

You may not:

• Modify, reverse engineer, decompile, or create derivative works of the App except to the extent permitted by law
• Use the Services for unlawful, misleading, or unauthorised purposes
• Interfere with or disrupt the integrity or performance of the Services
• Circumvent access controls, share login credentials, or permit unauthorised access
• Use automated systems (bots or scrapers) without our prior written consent

3. Professional Use & Scope Disclaimer

You are solely responsible for:

• Holding appropriate electrical qualifications and approvals
• Verifying all observations, labels, and interpretations independently
• Complying with applicable regulations including BS 7671:2018+A3:2024 and any local rules
• Using appropriate calibrated test equipment
• Producing official certificates using approved certification software where required

The App complements, and does not replace, professional expertise, judgment, or official certification systems.

4. AI-Powered Features (if enabled)

The App may include optional AI features that attempt to assist with image organisation, categorisation, or suggestions.

• AI outputs are guidance only and may be incomplete or inaccurate
• You must validate all AI suggestions against current regulations and site conditions
• You remain fully responsible for professional decisions and outcomes
• AI features do not replace testing, inspection, or certification

5. Team Sync and Shared Data (if enabled)

Where team functionality is available:

• You are responsible for inviting only authorised team members and managing permissions
• Data shared within a team remains the responsibility of the user who created it
• ElecCerts is not liable for errors, omissions, or inaccuracies in content shared by team members

6. Subscriptions and Payments

Certain features may require a paid subscription. Purchases are processed by your app store provider (Apple App Store or Google Play Store) under their terms.

By purchasing a subscription:

• You authorise recurring charges via your app store payment method
• Prices may change, with notice applied to future billing periods
• Refunds are governed by your app store's policies
• You can cancel at any time via your app store account settings
• We do not receive or store your full payment card details

Trial periods (where offered) automatically convert to paid subscriptions unless cancelled before the trial ends.

7. User Accounts and Data

You are responsible for maintaining the confidentiality of your account and for all activities under it. You must ensure that data you input (including client details and photographs) is accurate and lawful to process and share. You are responsible for backing up your own data.

We may suspend or terminate access for breach of these Terms, unlawful activity, or non-payment (see Section 11).

8. Intellectual Property

The Services, including all content, features, and functionality, are owned by ElecCerts and protected by UK and international intellectual property laws. You retain ownership of your content, but grant ElecCerts a licence to host, process, and transmit it as needed to operate the Services, including any AI processing you request and permitted team sync.

9. Acceptable Use

You agree not to upload or share content that is unlawful, defamatory, infringing, harmful, or that contains malware. You must not attempt to probe, scan, or test the vulnerability of the Services or breach security or authentication measures.

10. Limitation of Liability

To the maximum extent permitted by UK law, ElecCerts will not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, goodwill, or business interruption
• Reliance on AI outputs or automated features
• Errors in content provided by you or your team
• Non-compliance with regulatory requirements when using the App instead of official certification software

Our total liability for all claims arising out of or relating to the Services shall not exceed the amount you paid for ElecSnap GBR in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be excluded by law (e.g., death or personal injury caused by negligence, fraud).

11. Termination and Suspension

We may suspend or terminate your access immediately if you breach these Terms, engage in unlawful activity, share credentials, attempt to interfere with the Services, or fail to pay applicable fees.

Upon termination:

• Your right to use the Services ceases immediately
• We may delete your account and data after 90 days, subject to legal retention obligations
• You remain responsible for any fees due

12. Updates and Changes

We may update the App, the website, and these Terms from time to time. Continued use after changes take effect constitutes acceptance. For material changes, we will notify you within the App or via email.

13. Governing Law and Jurisdiction

These Terms and any dispute or claim (including non-contractual disputes) are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
